OVERVIEW

Welcome to Reclaim the Flag (“Reclaim the Flag”, “we”, “us”, “our”). We operate this website and store, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (the “Terms”) together with our Privacy Policy and Refund Policy explain your rights and responsibilities when using the Services. By visiting, interacting with, or purchasing from the Services, you agree to these Terms and our policies. If you do not agree, please do not use the Services.


1. ACCESS & ACCOUNTS

You confirm you are at least the age of majority in your country of residence. You are responsible for the security of your account credentials and all activity under your account.

To use the Services you may need to provide information (e.g., email, billing and shipping details, payment information). You warrant such information is accurate and that you have the right to provide it.


2. OUR PRODUCTS

We aim to describe products accurately, but colours/appearance may vary by device and settings. Descriptions, pricing and availability may change without notice. We may limit quantities or discontinue products at our discretion.


3. ORDERS

When you place an order you make an offer to buy. We may accept or decline any order. An order is accepted only when we send an order acceptance/dispatch confirmation. Please review orders carefully; cancellations may not be possible once processing begins.

Your purchases are subject to our Refund Policy.

You confirm items are for personal/household use and not for resale.


4. PRICES, TAXES & BILLING

Prices shown are in GBP and, unless stated otherwise, include VAT where applicable. Shipping, handling, and any customs/import charges are shown at checkout or otherwise notified.

Promotions may be subject to separate terms. If those conflict with these Terms, the promotion terms apply for that promotion.

You agree to keep your payment and contact details current and authorise us (and our payment providers) to charge your chosen method for order amounts.


5. SHIPPING, DELIVERY & RISK

Delivery timeframes are estimates. We are not liable for delays caused by carriers, customs, or events beyond our control. For consumer customers in the UK/EU, risk in the goods passes to you on delivery to you (or your nominated safe place/recipient), not when handed to the carrier.


6. INTELLECTUAL PROPERTY

All content and materials on the Services (including text, graphics, images, logos, and their arrangement) are owned by us or our licensors and are protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only and must not copy, modify, distribute, or create derivative works without permission. Our names, logos and marks are our trademarks. Other marks belong to their owners.


7. OPTIONAL TOOLS & NEW FEATURES

We may provide access to third-party tools “as is” and “as available” without warranties. Your use of such tools is at your own risk and subject to the third party’s terms. New features released in future form part of the Services and are subject to these Terms.


8. THIRD-PARTY LINKS

Third-party sites may be linked from the Services. We are not responsible for their content, policies, or transactions. Please review their terms before engaging.


9. RELATIONSHIP WITH SHOPIFY

Reclaim the Flag is powered by Shopify. However, sales on our Store are made by us, not Shopify. By using the Services you acknowledge Shopify is not responsible for your purchases from us and you release Shopify and its affiliates from claims relating to those transactions.


10. PRIVACY

Your personal information is handled per our Privacy Policy. Because our Store is hosted by Shopify, Shopify also processes certain data to provide and improve the Services; see the Shopify Privacy Policy.


11. FEEDBACK & REVIEWS

If you submit ideas, suggestions, reviews or other content (“Feedback”), you grant us a worldwide, perpetual, royalty-free, sublicensable licence to use and display it for any purpose. You warrant you have rights to the Feedback and that it complies with law and these Terms. We may moderate or remove Feedback at our discretion.


12. ERRORS & CORRECTIONS

We may correct errors or update information (including pricing/availability) without prior notice, including after you submit an order (in which case we’ll contact you if your order is affected).


13. PROHIBITED USES

You must not use the Services unlawfully or in ways that infringe rights, harass others, transmit malware, scrape, spam, circumvent security, or otherwise disrupt or misuse the Services. We may suspend or terminate accounts for violations.


14. CONSUMER CANCELLATION RIGHTS (UK/EU)

If you are a consumer in the UK or EU and buy goods online, you may have a 14-day cooling-off period from the day after delivery to cancel for a refund, except for made-to-order/personalised items or other statutory exceptions. See our Refund Policy for how to cancel and return items. Your statutory rights are not affected.


15. DISCLAIMER

Except as required by law or expressly stated by us, the Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.

Nothing in these Terms limits or excludes warranties, guarantees or rights that cannot be limited or excluded under applicable law. UK consumers retain all statutory rights under the Consumer Rights Act 2015 and related legislation.


16. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Subject to the above, we (and our officers, employees, agents and suppliers) will not be liable for: (a) loss of profits, sales, business or revenue; (b) business interruption; (c) loss of anticipated savings; (d) loss of business opportunity, goodwill or reputation; (e) loss or corruption of data; or (f) indirect or consequential losses. For paid goods/services, and to the extent permitted by law, our aggregate liability arising out of or relating to any order is limited to the amount you paid for that order.


17. INDEMNITY (BUSINESS USERS ONLY)

If you use the Services for business purposes, you agree to indemnify us against third-party claims arising from your breach of these Terms or infringement of rights.


18. FORCE MAJEURE

We are not liable for delays or failure to perform due to events beyond our reasonable control (including acts of God, strikes, outages, epidemics, extreme weather, or carrier disruptions).


19. SEVERABILITY

If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force.


20. WAIVER & ENTIRE AGREEMENT

Failure to enforce a provision is not a waiver. These Terms, together with our posted policies, are the entire agreement between you and us regarding the Services.


21. ASSIGNMENT

You may not assign or transfer your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations without notice.


22. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of England and Wales. Courts of England and Wales will have non-exclusive jurisdiction. If you are a consumer resident in the EU, you may also bring proceedings in your local courts.


23. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date and, where required by law, provide notice. Your continued use of the Services after changes take effect constitutes acceptance.
